1. Definitions
In these Terms: "Service" refers to residential care and programmes offered by Banyan Lodge; "User" refers to any individual who visits our website or contacts us; "We / Us / Our" refers to Banyan Lodge; "Agreement" refers to these Terms & Conditions together with any service-specific arrangement entered into.
2. Acceptance of Terms
By using this website or enquiring about our services, you agree to be bound by these Terms. You must be at least 18 years of age, or enquiring on behalf of an eligible person, to engage with our services. These Terms are governed by the laws of Hong Kong.
3. Service Description
Banyan Lodge provides residential accommodation for seniors at 5 Tai Tam Road, Stanley, Hong Kong. Our services include:
- Banyan Residence — long-term residential accommodation with meals, housekeeping, and care companion support
- Brush & Ink Workshop — a twice-weekly creative programme open to residents and outside participants
- Ten-Day Retreat Stay — a short-stay residential service providing full lodge services for ten days
Banyan Lodge is a residential home and does not provide medical, nursing, or clinical services of any kind.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate and complete information in all communications with us
- Use the website only for lawful purposes and in a way that does not infringe the rights of others
- Not attempt to gain unauthorised access to any part of our systems
- Notify us promptly of any changes to information relevant to a placement
5. Intellectual Property
All content on the Banyan Lodge website — including text, images, and design — is the property of Banyan Lodge and may not be reproduced without written permission. You are granted a limited, non-exclusive licence to view this content for personal, non-commercial purposes only.
6. Payment Terms
Service fees are as stated at the time of enquiry or agreement:
- Banyan Residence: HK$14,800 per month, payable in advance at the start of each calendar month
- Brush & Ink Workshop: HK$1,900 per month, payable in advance
- Ten-Day Retreat Stay: HK$5,800 per stay, payable upon confirmation
Payment is accepted by bank transfer to Banyan Lodge's designated account. Fees are stated in Hong Kong Dollars (HKD). We reserve the right to revise our fees, with reasonable advance notice provided to current clients.
7. Cancellation and Refunds
- Banyan Residence: One calendar month's written notice is required to end a placement. Fees paid for notice periods already commenced are non-refundable.
- Brush & Ink Workshop: Monthly fees are non-refundable once the month has commenced. Participants who cannot attend individual sessions are welcome to continue in subsequent sessions.
- Ten-Day Retreat Stay: Cancellations made more than 7 days before the stay begins will receive a full refund. Cancellations within 7 days of the stay are non-refundable.
8. Nature of Services — No Medical Care
Banyan Lodge provides residential and companionship services only. We do not provide medical, nursing, physiotherapy, psychiatric, or clinical services. Residents or their families are responsible for arranging any medical care through their own healthcare providers. Banyan Lodge accepts no liability for medical matters relating to a resident's health condition.
9. Disclaimers
Our services and website are provided in good faith, but without warranty of any specific outcome. We do not make representations about the suitability of our services for any particular individual's medical or care needs. Website content is provided for information only and does not constitute professional advice.
10. Limitation of Liability
To the maximum extent permitted under Hong Kong law, Banyan Lodge's liability in connection with its services is limited to the fees paid for the specific service giving rise to a claim. We exclude liability for indirect or consequential loss. Nothing in these Terms limits liability for fraud or personal injury caused by negligence.
11. Termination
We may terminate a service arrangement with reasonable written notice if the service is no longer appropriate to the resident's needs (including the emergence of medical requirements exceeding our scope), or in the event of a material breach of these Terms. In such cases, fees will be refunded on a pro-rata basis for any unused period, except where termination is due to a breach by the client.
12. Dispute Resolution
We will attempt to resolve any dispute through direct discussion first. These Terms are governed by the laws of Hong Kong, and any unresolved dispute will be subject to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.
13. General Provisions
These Terms represent the entire agreement between you and Banyan Lodge regarding our services, and supersede any prior representations. If any provision is found to be unenforceable, the remaining provisions continue in effect. Failure to enforce any right does not constitute a waiver of that right.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our services constitutes acceptance of the revised Terms.
